How this calculation works

"Hours worked" under FLSA includes all time an employee is required to be on duty, on the employer's premises, or at a prescribed workplace. Short rest breaks of 5–20 minutes are paid; bona fide meal breaks of 30+ minutes are not, provided the employee is fully relieved of duty.

Frequently Asked Questions

What counts as "hours worked" under FLSA?
Any time the employee is suffered or permitted to work — including short breaks (5–20 minutes) — counts as hours worked and must be paid. Only bona fide meal breaks of 30+ minutes where the employee is fully relieved are excluded.
Should travel time be counted?
Ordinary home-to-work commute is not counted. Travel between job sites during the workday is counted as hours worked under FLSA.
