The Core Formula: The 8/80 Rule

Under the FLSA, hospitals and residential care facilities can use a special overtime calculation called the “8 and 80” rule. Instead of the standard 40-hour workweek, overtime is triggered when an employee works more than 8 hours in a day OR more than 80 hours in a 14-day period.

Formula = OT when daily hours > 8 OR 14-day total > 80 (whichever triggers first, at 1.5×)

The employer has to choose either the standard 40-hour week or the 8/80 rule — they can’t flip between them. And night shift differentials are layered on top.

Step-by-Step: Calculating 8/80 Overtime

Say you’re an RN earning $40/hour base plus $5/hour night differential, working three 12-hour night shifts in a 14-day period.

  1. Daily hours. 12 hours per shift → 4 OT hours per shift (over 8).
  2. 14-day total. Let’s say 72 hours total (under 80).
  3. OT hours. 4 × 3 shifts = 12 OT hours.
  4. Regular rate. Includes the night differential → $45/hour.
  5. OT rate. $45 × 1.5 = $67.50/hour.
  6. OT pay. 12 × $67.50 = $810.
  7. Straight pay. (72 − 12) × $45 = $2,700.
  8. Total. $3,510 for the pay period.

Without the 8/80 rule, those same hours under a standard 40/week system might generate different OT — sometimes less, sometimes more.

Run your shifts through the shift work calculator to handle 8/80 and night differentials together.

2026 Real Case: Hospital RN Night Shift

Maria is an RN at a Florida hospital, $42/hour base + $4 night differential. She works four 12-hour shifts per week (48 hours) under the 8/80 schedule.

ShiftHoursDaily OT (over 8)
Mon night124
Tue night124
Thu night124
Fri night124
Total4816 OT hrs

Under 8/80, Maria gets 16 daily OT hours at $46 × 1.5 = $69/hr → $1,104 in OT, plus 32 hrs × $46 = $1,472 straight = $2,576 for the week. If the hospital used the standard 40/week rule instead, only 8 hours would be OT. A nurse I know switched employers and was shocked her 8/80 setup actually paid her more.

Where do people mess this up? They don’t realize the night differential has to be folded into the regular rate for OT calculation. OT isn’t 1.5× base — it’s 1.5× the regular rate including differentials.

Night Shift Differential and Overtime Layering

Pay ElementHow It’s CalculatedRequired by FLSA?
Base payAll hours × base rateYes (must clear min wage)
Night differentialPer employer policy/stateNo federally; some states
Overtime (8/80)1.5× regular rate (incl. diff) for OT hrsYes if elected
Overtime (40/week)1.5× regular rate for hrs over 40Yes, alternative

For the overtime rate itself, the time and a half calculator shows the math, and the overtime pay calculator totals the premium. Our rules for overnight shift work hour calculation guide covers night shift specifics, and how to calculate night shift differential pay breaks down the differential.

Frequently Asked Questions

What is the 8/80 overtime rule in healthcare?

The 8 and 80 rule allows hospitals and residential care facilities to pay overtime when an employee works more than 8 hours in a day or more than 80 hours in a 14-day period, instead of the standard 40-hour workweek. Employers must elect this method in advance and apply it consistently.

Does the night shift differential count toward overtime pay?

Yes. The night differential must be included in the regular rate of pay used to calculate overtime. So overtime is 1.5× the regular rate including the differential, not just 1.5× the base rate.

Can a hospital choose between 40/week and 8/80 overtime?

Yes, but the choice must be made in advance and applied consistently. Hospitals cannot switch between methods week to week to minimize overtime. Once elected, the method applies to all employees in the affected unit.

Are healthcare workers entitled to breaks on night shifts?

Federal law doesn’t require breaks, but most healthcare employers provide them by policy. Some states mandate meal and rest breaks. Breaks of 20 minutes or less must be paid under federal FLSA rules, and missed meal breaks may trigger premium pay in states like California.

Bottom Line

Healthcare has its own 8/80 overtime rule, and night differentials must fold into the regular rate. Run your night shifts through the shift work calculator to make sure OT and differentials both land on your check.
